Welcome to www.frankinelli.com (the "Website"). These Terms and Conditions ("Terms") govern your use of the Website and the purchase of products through it. By browsing the Website or placing an order, you accept these Terms in full. Please read them carefully and save a copy for your records.

Hereinafter, "Frankinelli", "we", "us" or "the Seller".
2. Scope
The Website operates as an online store. Through it you may purchase ready-made products (garments, leather goods and accessories) and request bespoke, made-to-measure services.
These Terms apply to consumers as defined by Italian Legislative Decree 206/2005 (the "Consumer Code"), meaning natural persons acting for purposes outside their trade, business or profession. Where a purchase is made by a business, the provisions of these Terms reserved for consumers — in particular the right of withdrawal under Section 9 — do not apply.
3. Products
Product images, colours and descriptions are provided as accurately as possible. Because our items are handcrafted from natural materials, small variations in grain, shade and texture between the photographs and the item you receive are inherent to the product and are not defects.
Products are offered while stocks last. If an item becomes unavailable after your order is placed, we will inform you promptly and refund you in full.
4. Formation of the Contract
- Adding products to the cart and completing checkout constitutes a binding purchase offer from you to us.
- You will receive an order acknowledgement by email. This confirms receipt of your order but does not conclude the contract.
- The contract is concluded when we send you a shipping confirmation, or — for bespoke orders — a written order acceptance.
- Before completing your order you will be able to review and correct your details, the items selected, the total price including shipping, and the delivery address.
- We reserve the right not to accept an order in cases of manifest pricing errors, unavailability of the product, incomplete or evidently incorrect customer details, or where we have reasonable grounds to suspect fraudulent use.
5. Prices and Payment
All prices are shown in Euro (EUR) and include VAT where applicable. Shipping costs are shown separately at checkout before you confirm your order.
For deliveries outside the European Union, customs duties, import taxes and clearance fees may apply on arrival. These are not included in the price and are payable by the recipient.
Accepted payment methods: credit and debit cards on the major circuits, PayPal, Shop Pay, Apple Pay and Google Pay.
Cash on delivery is not available.
Payments are processed by Shopify Payments and by the payment providers enabled on the Website. Frankinelli does not store your full card details.
6. Bespoke and Made-to-Measure Orders
Bespoke items are produced to your individual measurements and specifications following a consultation and one or more fittings.
For these orders:
- Measurements, materials, specifications, price and delivery terms are agreed individually and confirmed in writing before production begins.
- Because the item is made to your personal specifications, the statutory right of withdrawal does not apply, in accordance with Article 59(1)(c) of the Consumer Code. Your legal guarantee of conformity under Section 10 remains fully applicable.
7. Delivery
Shipping costs, carriers and delivery times for ready-made products are set out in our Shipping Policy, which forms an integral part of these Terms. Delivery terms for bespoke orders are agreed individually as set out in Section 6.
Unless otherwise agreed, delivery will be made within 30 days of the conclusion of the contract, as required by Article 61 of the Consumer Code. If we fail to deliver within this period, you may ask us to deliver within an additional reasonable period and, if we still fail to do so, terminate the contract and obtain a full refund.
Risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, take physical possession of the goods.
8. Inspection on Delivery
We recommend that you check the packaging before accepting delivery. If the parcel is visibly damaged or tampered with, please accept it "with reservation" (con riserva) noting the condition on the carrier's document, and contact us within a reasonable time with photographs. This helps us pursue the carrier, but it does not limit your rights under Sections 9 and 10.
9. Right of Withdrawal
If you are a consumer, you have the right to withdraw from your purchase within 14 days of the day on which you, or a third party designated by you, take physical possession of the goods — without giving any reason.
The full procedure, including the exceptions that apply, is set out in our Returns & Refunds Policy, which forms an integral part of these Terms.
10. Legal Guarantee of Conformity
Under Articles 128 to 135-septies of the Consumer Code, we are liable to consumers for any lack of conformity existing at the time of delivery and becoming apparent within two years of delivery.
Where a product is not in conformity, you are entitled — at no cost to you — to have the product brought into conformity by repair or replacement, or to receive a proportionate price reduction or termination of the contract, under the conditions set out by law.
To make a claim, write to info.frankinelli@gmail.com with your order number and photographs of the issue.
This guarantee is in addition to, and does not affect, your right of withdrawal under Section 9. Normal wear and tear, damage resulting from misuse or from failure to follow our care instructions, and the natural variation of leather and other natural materials are not defects.
11. Intellectual Property
All content on the Website — including text, photographs, video, graphics, trademarks and logos — is the exclusive property of Frankinelli or its licensors and is protected by applicable copyright and trademark law.
You may not reproduce, distribute, modify, publish, license or create derivative works from this content, or use it for commercial purposes, without our prior written consent.
12. Acceptable Use
You agree to use the Website lawfully and not to:
- interfere with the security, functionality or integrity of the Website;
- copy, scrape or bulk-download Website content without prior written consent;
- use the Website in any way that may damage, disable or impair its operation;
- place orders that are fraudulent or made in bad faith.
13. Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under mandatory applicable law — including our obligations under the Consumer Code.
Subject to the above, we are not liable for indirect or consequential loss, or for delays or failures caused by events outside our reasonable control.
The Website may contain links to third-party sites (for example Instagram or Facebook). We have no control over their content or practices and accept no responsibility for them.
14. Personal Data
Personal data collected through the Website is processed in accordance with our Privacy Policy and Cookie Policy, in compliance with Regulation (EU) 2016/679 (GDPR).
15. Complaints and Dispute Resolution
If something goes wrong, please contact us first at info.frankinelli@gmail.com. We aim to respond to complaints within [5] working days and to resolve them promptly.
If we cannot resolve the matter directly, as a consumer you may turn to an alternative dispute resolution (ADR) body registered with the competent Italian authorities, or to the conciliation service of the local Chamber of Commerce. Recourse to ADR is voluntary and does not affect your right to bring proceedings before the courts.
16. Amendments
We may amend these Terms at any time. Amendments take effect from publication on this page and apply to orders placed after that date. The Terms applicable to your purchase are those in force at the time your order was placed.
17. Governing Law and Jurisdiction
These Terms are governed by Italian law.
For consumers resident in the European Union, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and any dispute may be brought before the courts of the place where you are resident or domiciled.
For all other customers, the courts of Milan, Italy shall have jurisdiction, without prejudice to any mandatory provision of the law of the customer's country of residence.
