This Privacy Policy explains how we collect, use and protect your personal data when you visit www.frankinelli.com (the "Website"), place an order or contact us, in accordance with Regulation (EU) 2016/679 ("GDPR") and Italian Legislative Decree 196/2003 as amended.

We have not appointed a Data Protection Officer, as we are not required to do so under Article 37 GDPR. All privacy enquiries should be sent to the address above.


2. Categories of Data We Collect

Identification and contact data — first and last name, email address, postal address, telephone number.

Order and transaction data — items purchased, order value, order history, billing and shipping addresses, invoice details.

Payment data — payment method used and confirmation of the transaction. Payments are processed directly by our payment providers: we never receive or store your full card number.

Bespoke service data — measurements, fitting notes, fabric and style preferences, where you request a made-to-measure service.

Communication data — the content of your emails, contact form submissions, consultation requests and messages sent to us via social media.

Technical and browsing data — IP address, browser type, device type, operating system, pages visited, time spent on the Website, referring source. Collected through cookies and similar technologies.

Marketing preferences — your consent to, or withdrawal from, our newsletter and promotional communications.

4. Is Providing Your Data Mandatory?

Providing your identification, contact, delivery and payment data is necessary in order to conclude and perform a purchase contract. If you do not provide it, we cannot process your order.

Providing your data for marketing purposes is entirely optional. Refusing or withdrawing your consent has no effect on your ability to purchase from us, and you may withdraw it at any time.


5. Recipients of Your Data

Your data may be shared with the following categories of recipients, who act as processors on our behalf or as independent controllers where required by law:

  • Shopify Inc. and Shopify International Limited — the e-commerce platform that hosts our Website and processes orders;
  • Payment providers — Shopify Payments, PayPal, Apple Pay and Google Pay, for the processing of transactions;
  • BRT S.p.A. — our carrier, for the delivery of your order;

  • Analytics providers — Google, in relation to Website traffic analysis, where you have consented to the relevant cookies;
  • Professional advisers — accountants and, where necessary, legal advisers;

Processors are bound by a data processing agreement under Article 28 GDPR and may process your data only on our documented instructions.

We do not sell your personal data, and we do not disclose it to third parties for their own marketing purposes.


6. Social Media

If you contact us through Instagram or Facebook, your data will also be processed by Meta Platforms in accordance with its own privacy policy, over which we have no control. We recommend reviewing the privacy settings of those platforms.


7. Transfers Outside the European Economic Area

Some of our providers are established outside the EEA, which means your data may be transferred to third countries. Where this happens, the transfer takes place on one of the following legal bases:

  • Canada (Shopify Inc.) — on the basis of the European Commission's adequacy decision for Canadian commercial organisations;
  • United States — on the basis of the EU-US Data Privacy Framework, where the recipient is certified under it, and/or the Standard Contractual Clauses adopted by the European Commission, supplemented where necessary by additional safeguards.

8. Retention Periods

Customer account data For as long as the account remains active, and thereafter until you ask us to delete it
Bespoke measurements and fitting records 5 years from the last order, so that we can serve you on repeat commissions — deleted earlier on request
Marketing data 24 months from your last interaction with us, or until you withdraw your consent
Enquiries and correspondence not resulting in an order 24 months

Once these periods expire, data is deleted or irreversibly anonymised, unless it must be retained longer to establish, exercise or defend a legal claim.


9. Security

We apply appropriate technical and organisational measures to protect your data against unauthorised access, loss, alteration and disclosure. These include encrypted connections (HTTPS), access controls and the selection of providers offering adequate security guarantees.


10. Your Rights

Under Articles 15 to 22 GDPR you have the right to:

  • access your personal data and obtain a copy of it;
  • rectify inaccurate or incomplete data;
  • erase your data, where the conditions set out by law are met;
  • restrict processing in the cases provided for by law;
  • object to processing based on our legitimate interest, and at any time to processing for direct marketing purposes;
  • data portability, receiving your data in a structured, commonly used and machine-readable format;
  • withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal.

Right to lodge a complaint. If you believe that the processing of your data infringes the GDPR, you have the right to lodge a complaint with the Italian Data Protection Authority:

11. Automated Decision-Making

We do not carry out automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.


12. Minors

The Website is not directed at minors. We do not knowingly collect data from persons under 18. If you believe that a minor has provided us with personal data, please contact us and we will delete it.
